Terms of Service

§1. General Provisions
- These Terms of Service define the rules for providing electronic services through the website available at aivs.cc3.pl (hereinafter: "the Website").
- The owner and operator of the Website is UXELLENCE Łukasz S., NIP: 7511671443 (hereinafter: "the Service Provider").
- Contact with the Service Provider: email aivs@cc3.pl.
- Use of the Website constitutes acceptance of these Terms of Service.
§2. Definitions
- Service Provider – UXELLENCE Łukasz S., NIP: 7511671443.
- Client – a natural person conducting business activity, a legal entity, or an organizational unit without legal personality that uses the Website's services. The Website is aimed exclusively at businesses (B2B).
- AIVS™ Report – digital content in PDF format containing an analysis of the Client's brand visibility in AI-powered search engines, prepared based on the AIVS™ methodology.
- AIVS™ Scoring – a free service consisting of generating a synthetic visibility score (0–100) for a specified domain.
- Order – the Client's declaration of intent to enter into an agreement for the delivery of an AIVS™ Report, submitted through the form on the Website.
- Digital content – data produced and delivered in digital form, as defined by applicable consumer rights legislation.
§3. Types and Scope of Services
- The Service Provider offers the following services:
- AIVS™ Scoring (free) – analysis of domain visibility in AI systems, numeric score 0–100 with competitive benchmark, delivery within 24 hours.
- AIVS™ Report – Full Audit (paid) – detailed analysis across 6 weighted categories, 20 test queries on 5 AI platforms, competitor comparison, remediation priority roadmap, delivered in PDF format.
- The AIVS™ Report constitutes digital content under applicable law and is not recorded on a physical medium.
- The Service Provider notes that the AIVS™ Report is informational and analytical in nature. It does not constitute legal or business advice, nor a guarantee of achieving specific results.
§4. Ordering Conditions
- Orders are placed through the form available on the Website.
- The Client is required to provide true and complete data: domain for analysis, full name, email address, phone number, tax ID, company name.
- Placing an Order requires acceptance of these Terms of Service, consent to electronic invoicing, and consent to personal data processing.
- The agreement is concluded upon payment confirmation by the payment operator (Stripe).
- After concluding the agreement, the Client receives confirmation at the provided email address along with an access link to the client panel.
§5. Prices and Payments
- The price of the AIVS™ Report is 4,900 PLN net (approx. €1,150 / $1,250). VAT at 23% is added to the price where applicable under Polish tax law, bringing the gross amount to 6,027 PLN.
- Payment is processed through Stripe and includes: card payments (Visa, Mastercard), BLIK, and electronic transfers (Przelewy24).
- Payment is one-time. The Website does not offer subscriptions or recurring payments.
- A VAT invoice is issued electronically and sent to the Client's email address upon payment confirmation.
- Prices displayed on the Website are net prices unless explicitly stated otherwise.
§6. Service Delivery
- Work on the AIVS™ Report begins immediately upon payment confirmation, but no later than within 24 hours.
- The Report is delivered as a PDF file available for download through the client panel on the Website.
- Access to the client panel is provided through an individual link (token) sent to the Client's email address. The token is valid for 30 days from the date of generation.
- The Client is responsible for downloading and keeping a copy of the Report during the token availability period.
- The Service Provider does not guarantee the availability of the Report for download after 30 days from delivery.
§7. Withdrawal and No Refund Policy
- The Website is aimed exclusively at business clients (B2B). Services are not offered to consumers.
- The AIVS™ Report constitutes digital content that is not delivered on a physical medium. The right of withdrawal does not apply after the service has been performed, if performance began with the consumer's express consent before the withdrawal period expired and after being informed of the loss of the right of withdrawal.
- By placing an Order and making payment, the Client consents to the immediate commencement of the service and acknowledges awareness of losing the right to withdraw from the agreement upon commencement of the service.
- Due to the B2B nature of the service, the Client is not entitled to the right of withdrawal provided for consumers. All complaints are handled in accordance with §8.
- Refund for a delivered AIVS™ Report is not possible.
§8. Complaints
- The Client has the right to file a complaint in the event of non-performance or improper performance of the service by the Service Provider.
- Complaints should be submitted electronically to aivs@cc3.pl within 14 days of the Report delivery date.
- The complaint should include: Client identification data, order number or domain covered by the Report, description of the non-conformity.
- The Service Provider will process the complaint within 14 business days from the date of receipt and will inform the Client of the resolution electronically.
- If the complaint is accepted, the Service Provider may, at its discretion: deliver a corrected Report, grant a discount on the next service, or – in exceptional cases – refund all or part of the amount paid.
- Complaints are not applicable when the Report was prepared in accordance with the AIVS™ methodology and the Client disagrees with the analysis results or visibility assessment.
§9. Intellectual Property Rights
- The AIVS™ Report, AIVS™ methodology, the name "AI Visibility Score" and all content published on the Website are the intellectual property of the Service Provider and are protected by copyright law.
- The Client receives a non-exclusive, non-transferable, perpetual license to use the purchased Report for internal purposes.
- The following are prohibited: public sharing of the Report, resale, distribution, copying for commercial purposes, or using the Report in a manner that infringes the Service Provider's rights.
- The Client may quote excerpts from the Report with attribution to the source (aivs.cc3.pl) in their own materials.
§10. Liability
- The Service Provider exercises due diligence in preparing AIVS™ Reports in accordance with current methodology and knowledge.
- The Service Provider is not liable for:
- business decisions made by the Client based on the Report,
- changes in AI platform algorithms that may affect the relevance of results after Report delivery,
- the Client's failure to achieve specific AI visibility results,
- Website downtime resulting from technical reasons, maintenance, or force majeure,
- data loss resulting from failure to download the Report during the token availability period.
- The Service Provider's liability for non-performance or improper performance of the service is limited to the amount paid by the Client for the given service.
§11. Personal Data Protection
- The data controller of Clients' personal data is the Service Provider.
- Personal data is processed for the purpose of providing services, issuing invoices, communicating with the Client, and for the legitimate interests of the Service Provider.
- Detailed rules for personal data processing are defined in the Privacy Policy available at /en/privacy-policy.
- Providing personal data is voluntary but necessary for the provision of the service.
- The Service Provider uses the following data processors:
- Stripe, Inc. – payment processing,
- Supabase, Inc. – data storage,
- Resend, Inc. – email delivery,
- Vercel, Inc. – Website hosting.
§12. Technical Requirements
- To use the Website, the following are required: a device with internet access, an up-to-date web browser (Chrome, Firefox, Safari, Edge), an active email account.
- A PDF reader application is required to view the Report.
§13. Final Provisions
- The Service Provider reserves the right to amend these Terms of Service. Changes take effect on the date of publication on the Website. Changes do not apply to Orders placed before their effective date.
- Matters not regulated by these Terms of Service are governed by Polish law, in particular the Civil Code and the Act on Providing Electronic Services.
- Any disputes arising from the provision of services shall be resolved by the court having jurisdiction over the Service Provider's registered office.
- These Terms of Service come into effect on April 1, 2026.
